MWUK Competition Terms & Conditions

 

1.1 The following terms and conditions are applicable to any competition featured in any MWUK catalogue, postal message, mobile service, electronic messages, online activities, including www.alexandra.co.uk, and any other competitions organised by MWUK, or a third party on MWUK's behalf.
1.2 MWUK may cancel or amend any competition, competition details, or the following terms and conditions without prior notice. Any changes will be posted either within the competition details or the following terms and conditions.
1.3 By entering a competition entrants accept the following terms and conditions together with any specific instructions and terms for such competition which may be mentioned, on the internet, in any electronic messages, or communicated to entrants in any other way ("competition details"). Such competition details shall prevail in the event of there being any inconsistency between these competition terms and conditions and any specific competition detail.


Entering Competitions

2.1 The competition is open to all residents of the United Kingdom, which comprises England, Northern Ireland, Scotland, and Wales. Jersey, Guernsey, and the Isle of Man are not part of the United Kingdom for these purposes. MWUK reserves the right of ask competition winners for proof of UK residency and if a competition winner is unable to prove their residency to MWUK's satisfaction (i.e. prove that they are physically present in the UK for 183 days or more in the previous or current UK tax year), MWUK reserves the right to select an alternative winner. Entrants of competitions must be 18 years of age or older to be eligible to claim any prize, discount, or benefit associated to a competition.

Employees and members of their immediate families (including any live-in partner or household member) or any of the following may not enter:
Organisations associated to or with MWUK;
Any organisation involved in the implementation, management, promotion, or administration of the competition or its entry routes or donation of prizes or their agents or subsidiaries;
Any organisation involved in any capacity in the production or sponsorship of a competition, promotion, or benefit to which the competition relates.
2.2 The opening and closing dates and times for entries are as indicated in the competition details. Any entries received before the opening date and time and after the closing date and time of the competition will be invalid and will not be entered into the competition.
2.3 Where the competition details specifies a minimum or maximum age limit MWUK reserves the right to ask for proof of age and in all competitions evidence to verify the identity of an entrant at any time, and may use any channels and methods available to carry out checks of any details provided. Entrants may only enter the competition in their own name.
2.4 Any limit on the number of entries a person, premises, or organisation may make will be clearly stated in the competition details. Entries received in excess of this limit will be invalid and will not be entered into the competition.
2.5 Where indicated in the competition details, some competitions are only open to registered users of the alexandra.co.uk website. There is no charge for registration on the alexandra.co.uk website.
2.6 By entering the competition entrants warrant that all information submitted by them is true, current, and complete. Entrants also warrant that they are the copyright owners of any copyright works submitted, for example photographs and drawings, and MWUK's use of such submissions will not infringe the rights of any third party.
2.7 Entry to any competition may only be made through the applicable method(s) indicated in the competition details. Not all of the methods of entry that follow may be available for entry to every competition. The following terms and conditions will apply where the method is indicated as being available in the competition details. Where entrants pay an entry fee, they must have the permission of the bill payer before entering. Entries without the permission of the bill payer will be invalid. MWUK warrants that the cost of any product purchased from Alexandra during the duration of the advertised competition will be at the standard published price or Account agreement.
Internet entry
Internet entrants are required to follow the instructions on the website as indicated in the competition details. MWUK reserve the right to not communicate to entrants that they have been successfully entered into any competition. Competitions where confirmation will be offered shall have so stated in the competition details. Internet entrants may be required to supply their first name, last name, email address, contact telephone number and/or any other details in order for their entry to valid. In the event that entrants are required to pay to enter online, entrants will need to use the relevant payment service indicated in the competition details, and may need to open an account and register to pay for online entry to the competition. Online entry costs will be as indicated in the competition details. Entrants must read and accept the terms and conditions relating to the online entry pay service before proceeding with such a web entry.
Email entry
Email entrants may enter the competition by sending an email with the information indicated in the competition details and to the email address stated. MWUK reserve the right to not communicate to entrants that they have been successfully entered into any competition. Competitions where confirmation will be offered shall have so stated in the competition details. There is no charge for email entries.
Social network sites entry
Social Network Site entrants may enter the competition by responding with the information indicated in the competition details by posting their answer within their comment. MWUK reserve the right to not communicate to entrants that they have been successfully entered into any competition. Competitions where confirmation will be offered shall have so stated in the competition details. There is no charge for such entries.
Phone entry
Phone entrants are required to call the phone number as indicated in the competition details. The charge per call will be as indicated in the competition details and is based on the cost of a call from a BT fixed network line. The cost of entering from other networks will vary and from mobiles will cost considerably more. It is the entrant's responsibility to check the cost of their call before entering. Once the telephone number is dialled and the entrant is connected they will be charged the cost of entry (together with any applicable alternative network or mobile operators' charge). Please contact your phone network for details of any associated costs that can be incurred. Phone entries received after the notified competition closing date and time will not be valid. MWUK reserve the right to not communicate to entrants that they have been successfully entered into any competition. Competitions where confirmation will be offered shall have so stated in the competition details.
Text message entry
Text message entrants are required to send a text to the shortcode or number as indicated in the competition details. Text messages received by MWUK will be charged at the standard operator rate, which will vary depending on the entrant's mobile network provider. When a text message is received from MWUK, sent to the same mobile phone from which the answer was sent, acknowledging receipt of the entry (a "Text Acknowledgement"), this will result in the entrant being charged the charge stated in the competition details. Please check with the relevant mobile network provider what standard network charge will apply. In the event that the entrant has insufficient funds, credits or capacity on their handset (as applicable) for the Text Acknowledgement to be successfully sent by MWUK and received by the entrant within 72 hours of the original entry being received by MWUK, the relevant entry will be deemed ineligible and will not be accepted.

Entries sent by text message which are received after the stated competition closing date and time will be invalid and will not be entered into the competition. MWUK reserve the right to not communicate to entrants that they have been successfully entered into any competition. Competitions where confirmation will be offered shall have so stated in the competition details. The entrant will not be entitled to a refund of the standard network charge imposed by the entrant's mobile network when they entered the competition by text message.

Text message entries received after the notified competition closing time will not be valid. MWUK accepts no liability for any text message entry charges incurred regardless of whether the entry is received before the competition closing time. SMS entrants will receive a SMS confirmation text message of their entry, which may include information about the competition, related suppliers or other services relating to the competition and/or MWUK.
Postal entry
Postal entrants may be required to send their answer, first name, last name, postal address, email address and a contact telephone number (or such contact details as are requested in the competition details) to the postal address indicated in the competition details in order for their entry to be valid. Entries should be sent either on a postcard, or and/or in a sealed envelope. Entries received in any other form may be deemed invalid. MWUK reserve the right to not communicate to entrants that they have been successfully entered into any competition. Competitions where confirmation will be offered shall have so stated in the competition details.
2.8 Neither MWUK nor its servants, agents, nor any other party or organisation involved in the management, promotion, or administration of the competition or its entry routes or donation of prizes or their agents or subsidiaries involved in the competition will accept responsibility or liability for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions (including but not limited to security functions by software used by MWUKor any third party), virus, bugs, or other causes outside its control.
2.9 Entrants may enter as many times as they like unless otherwise indicated in the competition details but no more than one prize per person per organisation / individual will be awarded.
2.10 Entries submitted through agents, a third party or in bulk (i.e. more entries than physically possible in the time available without the immoral use of software or other devices designed to make automated entries or, in the case of postal entries, more than one entry submitted under the same postage stamp) will not be valid.
2.11 An entry to the competition will be deemed to be an invalid entry where an entrant has evaded payment of any applicable entry charges when entering the competition or, in the case of postal entry, has failed to pay and affix the correct postal charges.
2.12 Any entries which are incomplete, incorrect, inaudible, incomprehensible, or not received by MWUK will be void.
2.13 In the event of any fault, mistake, misunderstanding or dispute concerning the correctness or acceptability of the entry or any answers given by entrants, or the function of any part of the competition, postal, network or phone system, the decision of MWUK shall be final and no correspondence will be entered into.
2.14 MWUK reserves the right to exclude any entry from a competition if it has been effected by deliverability issues outside of MWUK’s control.
2.15 MWUK will not be liable to reimburse any expenses incurred in making an entry in any competition. Where MWUK decides in its sole discretion that an entrant is eligible for a refund, eligibility for refunds will be notified to relevant entrants. MWUK reserves the right to refuse to refund any messages where it suspects dishonest or fraudulent conduct on the sender’s part or where the entrant has not complied with the rules of the competition (for example, in exceeding the maximum number of entries as stated in the competition details).


Competition Prizes

3.1 The prize is as specified in the competition detaills.
3.2 MWUK reserve the right to award ownership of any prize, discount, or benefit associated with a competition to the winner’s associated organisation rather than an individual in order to comply with any aspect of the Bribery Act 2010.
3.3 All entries, although made by an individual, are for and on behalf of the organisation that they represent and must have permission to represent. Winners will accept any prize, in any form, for and on behalf of that said organisation and any dispute of representation is a private matter and MWUK has no liability for the actions taken by the individual entering a competition held by MWUK.
3.4 Prize draw prizes will be awarded in accordance with the laws of chance and, if required by law or regulation, under the supervision of an independent adjudicator. Any competition requiring a subjective assessment in the selection of winning entries will be judged from all valid entries by MWUK or as indicated in the competition details and, if required by law or regulation, an independent judge or an assessment panel including one member who is independent of the competition's promoters, suppliers, or any associated third party. Selection of winning entries is final and no correspondence will be entered into.
3.5 The process for determining the winner of the prize is as indicated in the competition details. Where the winner is randomly selected from all correct and valid entries, the draw for the winner will where possible take place within 14 days of the closing date stated in the competition details.
3.6 MWUK will attempt to notify the winner for up to 28 days after the closing date and time for entries to the competition, or as otherwise indicated in the competition details, and where time is limited for such a period as MWUK shall in its absolute discretion deem reasonable. The winner shall be contacted on the phone number, by text message, email, or postal address provided when entering the competition. The winner will have a specified fixed time period in which to claim any associated prize. If MWUK is unable to notify the winner, or if the winner fails to respond within the fixed time period as specified and/or provide an address for delivery of the prize, this may result in forfeiture of the prize and MWUK reserves the right to select an alternative winner in accordance with these terms and conditions and the competition details.
3.7 Should more prizes be claimed than are available for any reason, a prize draw will take place for the prize(s) associated to the competition.
3.8 Any entrant who enters or attempts to enter the competition in a manner, which in MWUK’s decision, is contrary to these terms and conditions or is, but not limited to, fraudulent, unjust, or threatening to other entrants, MWUK, or any other associated third party, may be rejected from the competition at MWUK’s sole discretion.
3.9 MWUK may in its sole discretion refuse to provide a prize, or seek its recovery, in the event of non-entitlement under these terms or an entrant's breach of these terms, MWUK’s website terms of use, fraud, deceit, dishonesty, or other inappropriate or improper conduct, as is decided by MWUK, including but not limited to the use of technology which enables an entrant to evade charges when entering the competition or the improper use of technology when entering the competition. Where a competition can be entered online we reserve the right to refuse to provide a prize if the winner’s alexandra.co.uk account has been cancelled for any reason and/or the winner has been banned from registering a new alexandra.co.uk for any reason.
3.10 MWUK reserves the right to modify, cancel, terminate or suspend any competition in whole or in part, at its sole discretion, if it believes the competition is not capable of being conducted as specified in these terms and conditions or in the event of a virus, computer bug or unauthorised human intervention or any other cause that is beyond the reasonable control of MWUK that could corrupt or affect the administration, security, impartiality, or normal course of the competition.
3.11 In certain circumstances as decided by MWUK a cash alternative may be offered. Such circumstances may include, but are not limited to, the prize being no longer available, the prize including tickets to an event. If no cash alternative is offered, this will be stated in the Terms and Conditions.
3.12 MWUK endeavours to deliver the prize to the winner within 28 days from the date of the prize draw/ruling, unless otherwise specified to the winner. Delivery restrictions may apply. No cash equivalent (where applicable) or alternative prize will be given and the prize is non-transferable and non-exchangeable. However, MWUK reserves the right to change the prize due to circumstances beyond its control or to offer an alternative of similar value.
3.13 MWUK reserves the right in its sole discretion to withhold delivery of the prize until such proof of eligibility and identity has been confirmed or if such proof is not produced on request or to disqualify the entrant from the associated competition and any future competitions.
3.14 In relation to all competitions, the first name, surname and associated organisation of the winner may be published by MWUK and also be obtained by sending a SAE to Marketing, MWUK, Midland Way, Thornbury, Bristol, BS35 2NT, including the name of the competition within 3 months of the closing date. By entering the competition, entrants grant to MWUK a non-exclusive licence to use and publish their entry in any media for the purpose of announcing the winner.


Data Protection and Publicity

4.1 MWUK, or any third party nominated by MWUK may exercise its sole discretion to use the winner's (and, if applicable, their organisation's) name, address, and image and their comments relating to the prize and competition experience for future promotional, marketing and publicity purposes in any media worldwide without notice or without any fee/compensation being paid to the winner or any associated organisation or third party.
4.2 Information, data and the caller line identity ("personal informtation") which is provided by entrants when they enter will be held and used by MWUK, their suppliers and any associated third party in order to administer the competition. If entrants call from a withheld caller line identity and do not provide their caller line identity when entering the competition, MWUK may use the withheld caller line identity for customer care purposes such as refunds or communications relating to a service. Entrants' personal data may also be passed to their mobile phone network or to relevant regulatory bodies, the police or other authorities in the course of the investigation of any complaints or suspected unlawful activity or where requested by the phone provider in connection with the billing arrangements for the competition. Aggregate, non personal data may also be used for the purpose of undertaking market research or in facilitating reviews, developments and improvements to any relevant services, as decided by MWUK.
4.2 Any personal data will only otherwise be used in accordance with MWUK’s privacy policy which can be viewed at http://www.alexandra.co.uk/PrivacyPolicy.aspx. Any entrant who is entering the competition via text mesage may opt out of receiving any marketing communications from MWUKby adding the word UNSUBSCRIBE after the keyword as specified in the competition information.


Liability

5.1 Nothing in these terms and conditions shall exclude or limit MWUK's liability for death or personal injury caused by their staff or supplier's negligence or for fraud. Subject to this, MWUK cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the competition or as a result of accepting any prize. MWUK is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in the competition.
5.2 MWUK cannot promise that the services relating to the competition will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond the control of MWUK. MWUK will not be liable in the event that all or any part of the service relating to the competition is discontinued, modified or changed in any way.

6.2 In the event that any entrant or any associated organisation does not, or is unable to, comply with and meet these terms and conditions and the competition details, MWUK shall be entitled at its sole discretion to disqualify such entrant and any associated organisation, without any further liability to such entrant or any associated organisation. In these circumstances, any associated prize(s) won by the entrant may be forfeited and MWUK reserves the right to reclaim any prize(s) already distributed to the entrant or any associated organisation. Any entrant and any associated organisation must comply with any directions given to them, or any associated organisation by MWUK including but not limited to any and all relevant laws, rules and regulations.
6.3 The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision or law. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms and Conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
